Be it enacted by the General Assembly of Virginia:

1.  That § 22.1-291.1 of the Code of Virginia is amended and reenacted as follows:

§ 22.1-291.1. Planning time for school teachers.

Each school board shall seek to ensure that all  [  elementary elementary  ]  school teachers in its employment are provided at least  [ three hours an average of 30 minutes per day  ]  during the students' school week as [  unencumbered, self-directed  ]  planning time.

 [ 2. That the provisions of this act shall not become effective unless an appropriation of general funds effectuating the purposes of this act is included in a general appropriations act passed by the 2008 Session of the General Assembly, which becomes law.  ]
