082845272Be it enacted by the General Assembly of Virginia:
1. That Chapter 819 of the Acts of Assembly of 2007 is amended by adding a fourth enactment as follows:
4. That the provisions of this act shall apply to the following persons who retire from service on or after July 1, 2002: (i) a deputy sheriff of a county or city that participates in the Virginia Retirement System (§ 51.1-124.1 et seq. of the Code of Virginia), (ii) a sheriff of a political subdivision that participates in the Virginia Retirement System, (iii) any other person included in a class of public safety officers described in subsection B of § 51.1-138 of the Code of Virginia of a county or city that participates in the Virginia Retirement System, provided that the county or city has elected to provide the enhanced retirement benefits pursuant to such subsection for such class of public safety officers, and (iv) a state police officer pursuant to § 51.1-201 of the Code of Virginia. Such sheriffs and state police officers shall have their retirement allowances computed using a 1.85 percent multiplier for average final compensation and shall receive the annual supplement described in subsection B of § 51.1-206 of the Code of Virginia.
However, any increase in retirement benefits as a result of this act for such persons described in clauses (i) through (iv) who retired from service on or after July 1, 2002, but prior to July 1, 2007, shall only be available on a prospective basis, beginning July 1, 2008.
