Be it enacted by the General Assembly of Virginia:

1. That § 23-2.1:2 of the Code of Virginia is amended and reenacted as follows:

§ 23-2.1:2. Birth certificate required for admission; retention of certain documents authorized.

A. If any Each public institution of higher education in Virginia, shall require every first-time entering freshman to present, as a condition of enrollment, requests that a student present a certified copy of his birth certificate, that includes his place and country of birth. a A certified copy may of the birth certificate shall be retained by the institution in the student's record. If a certified copy of the student's birth certificate cannot be obtained, the student shall submit an affidavit setting forth his place and country of birth and explaining the inability to present a certified copy of the birth record. No student shall be admitted for the first time to any public institution of higher education in the Commonwealth unless the student presents a certified copy of his birth certificate or submits an affidavit including such information.

B. No student enrolling in a public institution of higher education who fails to present a certified copy of his birth certificate or to submit an affidavit as required in subsection A, shall be eligible for reduced in-state tuition pursuant to § 23-7.4, or eligible to receive state financial aid.

C. The board of visitors of each public institution of higher education and the Board for Community Colleges shall report annually the number of students enrolled at each institution, without disclosing personally identifiable information, by place and country of birth to the State Council of Higher Education. Each institution and the Board for Community Colleges shall also post such information on their respective websites and shall make such information available in writing upon request. The State Council of Higher Education shall post the aggregate number of students enrolled in public institutions of higher education by place and country of birth on its website.
