Be it enacted by the General Assembly of Virginia:
1. § 1. That in order to provide a guide for the efficient and effective investment in public facilities, the General Assembly creates the 21st Century Capital Improvement Program (CIP) which is a dynamic program that will be revised annually for the acquisition, development, enhancement, planning or replacement of public facilities over a multiyear period to serve the citizens of the Commonwealth of Virginia. By looking beyond year-to-year budgeting and creating a program that outlines Virginia’s capital needs, the Commonwealth will be able to maintain and deliver an effective level of service for present and future populations. The CIP will also provide for the orderly and systematic programming and financing of capital projects. The CIP will be developed in conjunction with the Commonwealth budget process.
§ 2. Scope and priority of funding.
The CIP will cover capital projects supported in whole or in part by general funds. Capital projects will be listed by agency, in agency priority order. However, priority for funding will be determined by the General Assembly based upon projects that:
1. Have already received planning funds and have completed that process;
2. Impact life safety;
3. Upgrade major mechanical systems;
4. Renovate existing facilities;
5. Provide new construction that increases research capacity or enrollment capacity at institutions projected to grow;
6. Meet State Council of Higher Education for Virginia guideline parameters;
7. Improve energy efficiency; or
8. Have been reviewed and value engineered by the Department of General Services.
§ 3. Role of the State Council of Higher Education for Virginia.
The State Council of Higher Education for Virginia ("SCHEV") shall develop policies, formulae, and guidelines for the fair and equitable distribution and use of public funds among the public institutions of higher education, taking into account enrollment projections and recognizing differences as well as similarities in institutional missions. Such policies, formulae, and guidelines as are developed by the Council for capital outlay programs shall be utilized by all public institutions of higher education in preparing requests for appropriations. The Council shall consult with the Department of Planning and Budget in the development of such policies, formulae, and guidelines to insure that they are consistent with the requirements of the Department of Planning and Budget.
Not less than 30 days prior to submitting its biennial budget request to the Governor, the governing board of each public institution of higher education shall transmit to the Council such selected budgetary information relating to its budget request for capital outlay as the Council shall reasonably require. The Council shall analyze such information in light of the Council's plans, policies, formulae, and guidelines and shall submit to the General Assembly and the Governor recommendations for approval or modification of each institution's request together with a rationale for each such recommendation. The Council shall make available to the General Assembly its analyses and recommendations concerning institutional budget requests.
Nothing herein shall prevent any institution from appearing through its representatives or otherwise before the Governor and his advisory committee on the budget, the General Assembly, or any committee thereof at any time.
§ 4. Role of the Department of General Services.
1. The Department of General Services ("DGS") shall ensure that value engineering is employed for any capital project included in or requested to be included in the CIP. Value engineering means a systematic process of review and analysis of a capital project by a team of persons not originally involved in the project. Such team, which shall include appropriate professionals licensed in accordance with Chapter 4 (§ 54.1-400 et seq.) of Title 54.1 of the Code of Virginia, may offer suggestions that would improve project quality and reduce total project cost by combining or eliminating inefficient or expensive parts or steps in the original proposal or by totally redesigning the project using different technologies, materials, or methods. The Department of General Services shall make its value engineering recommendations to the General Assembly and Governor for all projects in the CIP by November 1 of each year.
2. The Director of the Department of General Services, in consultation with state agencies and institutions, shall recommend the appropriate construction method for each project. The construction of each facility may be by design-bid-build procured by competitive sealed bidding, construction management, or design-build, whichever is the most cost effective and advantageous to the Commonwealth. An analysis on the respective advantages and disadvantages of the use of design-bid-build, construction management, and design-build shall be provided to the Director of the Department of General Services by the entity constructing such facility. Based upon that report and the independent analysis of Director of the Department of General Services, the Director will decide on the use of design-bid-build, construction management, or design-build for that particular facility. The approval of the Director for such use of any construction method may be conditioned upon the compliance by the entity constructing such facility with such conditions as the Director determines appropriate.
Whenever design-build or construction management is used for the construction of a facility, the entity constructing such facility shall in its procurement affirmatively consider that for years the Commonwealth did not allow or encourage construction management or design-build, thus limiting the ability of Virginia-based contractors to have as much experience under construction management or design-build as competitors working in the private sector and other public sector jurisdictions. A Virginia-based contractor who does not have the same number of years of comparable experience under construction management or design-build shall not be penalized for having less comparable experience in construction management or design-build projects, provided such contractor does have experience with constructing comparable projects under design-bid-build. The entity shall consider the experience and quality of work that a firm has done on comparable projects, whether under construction management, design-build, or design-bid-build. These factors shall be considered by the entity in making its decisions in a pre-qualification or a contractor selection process.
§ 5. Agency proposed revisions to projects.
State agencies and institutions of higher education shall annually submit any revisions that they have to projects that are in CIP. The agencies shall submit these revisions to the General Assembly and Governor by October 1 of the year immediately prior to the beginning of each regular session of the General Assembly. The agencies shall include:
1. Changes in cost estimates;
2. Changes in project priority with an explanation for the change; and
3. Changes in evaluations from SCHEV or DGS on existing projects.
§ 6. Governor's submission of proposed new projects.
On or before November 1 of the year immediately prior to the beginning of each regular session of the General Assembly, the Governor shall submit to the members of the General Assembly for their consideration any new projects to be added to the CIP. The submission shall:
1. Identify each capital outlay project;
2. Describe the scope and nature of the project;
3. Provide an estimate of the total cost of each project upon payment in full;
4. Detail, by fiscal year, the source or sources of funds recommended for each capital outlay project;
5. Explain the specific criteria or justification that was used in determining the fiscal year in which funds were allocated to projects; and
6. Include any other information as may be requested by the General Assembly.
§ 7. Legislative intent for amounts appropriated.
1. a. If bids for projects funded under this program are in excess of the funding provided by the General Assembly, agencies and institutions are authorized to supplement projects from other fund sources such as private funds, gifts, grants, auxiliary funds, or federal funds as appropriate.
b. In the event agencies or institutions are unable to supplement projects from sources specified in 1 a, agencies and institutions are authorized to reduce the size and the scope of the project as necessary to remain within the available funds appropriated.
2. Agencies are permitted to seek a supplemental appropriation through the executive budget process provided, however, that they (i) certify that alternative funding as outlined in paragraph 1 a is not available and (ii) submit to the House Appropriations Committee, Senate Finance Committee, Department of General Services, Department of Planning and Budget, and the State Council of Higher Education (for institutions of higher education only) an analysis of what the reduced project would be as well as a justification for why the change in size and scope cannot be achieved.
2. § 1. That to begin the 21st Century Capital Improvement Program's selection of capital improvement projects, the General Assembly designates the following projects.

3. § 1. That pursuant to § 2.2-2264 of the Code of Virginia, the General Assembly hereby authorizes the Virginia Public Building Authority ("VPBA") to undertake the construction, improvement, and furnishing of the following projects including, without limitation, constructing, improving, furnishing, maintaining, acquiring, and renovating buildings, facilities, improvements, and land therefor; and to exercise any and all powers granted to it by law in connection therewith, including the power to finance all or any portion of the cost thereof by the issuance of revenue bonds in a principal amount not to exceed $152,429,000 plus amounts needed to fund issuance costs, reserve funds, original issue discount, interest prior to and during acquisition, construction, or renovation and for one year after completion thereof, and other financing expenses.

4. § 1. That pursuant to § 23-30.28 of the Code of Virginia, the General Assembly hereby authorizes the Virginia College Building Authority to undertake the following projects including, without limitation, constructing, improving, furnishing, maintaining, acquiring and renovating buildings, facilities, improvements, and land therefor; to exercise any and all powers granted to it by law in connection therewith, including the power to lease such projects to institutions of higher education of the Commonwealth; and to finance all or any portion of the cost thereof by the issuance of revenue bonds in a principal amount not to exceed $407,387,933 plus amounts needed to fund issuance costs, reserve funds, original issue discount, interest prior to and during acquisition, construction or renovation and for one year after completion thereof, and other financing expenses.
The Authority may pay all or any part of the cost of any project hereinafter listed or authorized or any portion thereof with any income and reserve funds of the Authority available for such purpose, and in such case may transfer such funds of the Authority, with the approval of the Governor.

§ 3. Institutions and agencies may request authority and appropriation to conduct planning for any project listed in the second enactment of this act using nongeneral fund sources. Such amounts may be reimbursed up to the lesser of $250,000 or one percent of the project construction costs.
6. That § 2.2-1503.2 of the Code of Virginia is repealed.
