Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 54.1-407.1 as follows:

§ 54.1-407.1. Land surveying; state and local government employees; requirements for license.

A. Notwithstanding the provisions of this article, any person engaged in the practice of land surveying as an employee of the Commonwealth or any political subdivision shall be allowed to use such experience toward the requirements for a licensed land surveyor. In order to be approved to take the examination for the Principles and Practices of Land Surveying and the Virginia state-specific examination, such person shall (i) have a surveyor-in-training designation by the Board; (ii) have a minimum of four years of approved surveying experience, which may be gained prior to the surveyor-in-training designation; and (iii) provide written references from three land surveyors licensed in a state, territory, or possession of the United States, or the District of Columbia, each having personal knowledge of the applicant’s surveying experience.

B. References shall be in writing and shall be no more than one year old at the time the application is received by the Board. Individuals who provide references shall have known the applicant for at least one year. References may not also verify experience.

C. For the purposes of this section:

“Approved surveying experience” means a record of progressive experience on surveying work, under the direct control and personal supervision of an individual authorized by statute or regulation to practice surveying, during which the applicant has made practical utilization of acquired knowledge and has demonstrated continuous improvement, growth, and development through the utilization of that knowledge as revealed in the complexity and technical detail of the applicant’s work product or work record. The applicant shall show continuous assumption of greater individual responsibility for the work product over the relevant period. The progressive experience on surveying work shall be of a grade and character that indicates to the Board that the applicant is minimally competent to practice surveying.
