A BILL to amend and reenact § 33.1-391.15 of the Code of Virginia and to amend the Code of Virginia by adding a section numbered 33.1-391.9:1, relating to the Hampton Roads Transportation Authority; legislative requests and recommendations of Authority to General Assembly; effective date for imposition and collection of certain taxes, fees, and charges dedicated to financing Authority's operation and programs.

Be it enacted by the General Assembly of Virginia:

1. That § 33.1-391.15 of the Code of Virginia is amended and reenacted and the Code of Virginia is amended by adding a section numbered 33.1-391.9:1 as follows:

§ 33.1-391.9:1.  Legislative requests and recommendations of Authority to General Assembly.

Before transmitting any legislative request or recommendation to the General Assembly, any such proposed request or recommendation shall first be referred to each of the Authority's constituent local governments.  Each such constituent local government shall conduct a public hearing on such proposed request or recommendation and then take a vote upon the proposed request or recommendation in open session.  If such proposed request or recommendation is agreed to by a majority vote, the constituent local government shall communicate that action to the Authority.  No final action shall be taken by the Authority on any such proposed request or recommendation unless and until the Authority shall have conducted another public hearing on the matter and agreed to transmission of the proposed request or recommendation by a majority vote of those voting members present and voting.

§ 33.1-391.15. Use of revenues by the Authority.

Notwithstanding any other provision of this chapter, all moneys received by the Authority shall be used by the Authority solely for the benefit of those counties and cities that are embraced by the Authority, and such moneys shall be used by the Authority in a manner that is consistent with the purposes stated in this chapter. Notwithstanding any contrary provision of law, no tax or fee charged or imposed and dedicated to financing the operation and programs of the Authority pursuant to Chapter 896 of the Acts of Assembly of 2007 shall be imposed or collected prior to July 1, 2009.
