Be it enacted by the General Assembly of Virginia:

1.  That § 46.2-862 of the Code of Virginia is amended and reenacted as follows:

§ 46.2-862. Exceeding speed limit.

A. A person shall be guilty of reckless driving who drives on the highways in the Commonwealth a motor vehicle, vehicle or combination of vehicles used to transport property that either has a gross vehicle weight rating of 26,001 or more pounds or a gross combination weight rating of 26,001 or more pounds inclusive of a towed vehicle with a gross vehicle weight rating of more than 10,000 pounds at a speed of ten miles per hour or more in excess of the applicable maximum speed.

B. A person shall be guilty of reckless driving who drives a motor vehicle other than vehicles described in subsection A on the highways in the Commonwealth (i) at a speed of twenty miles per hour or more in excess of the applicable maximum speed limit or (ii) in excess of eighty miles per hour regardless of the applicable maximum speed limit.
