080235508Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Chapter 7 of Title 19.2 a section numbered 19.2-83.2 as follows:
§ 19.2-83.2. Verifying the citizenship status of persons confined in a jail.
A. When a person has been arrested and is confined, for any period, in any county or municipal jail or a jail operated by a regional jail authority, a reasonable effort shall be made by the sheriff or regional jail administrator to determine the citizenship status of the person so confined. The sheriff or regional jail administrator shall report any person determined to be in the United States illegally to the Law Enforcement Support Center of the Bureau of Immigration and Customs Enforcement.
B. The Department of Corrections shall prepare and issue guidelines and procedures to be used to comply with the provisions of this section.
2. That the Virginia State Bar shall investigate the practice of providing legal advice to illegal immigrants and shall establish guidelines as to what constitutes unauthorized practice of law in that regard.
