2008 SESSION
Be it enacted by the General Assembly of Virginia:
1. That § 4, as amended, of Chapter 261 of the Acts of Assembly of 1960 is amended and reenacted as follows:
§ 4. (a) The council may appoint a clerk, a town attorney and such other officers (including those in subsection (b) of this article) as well as such other committees of the council and create such boards and departments as it deems necessary or proper, and define their duties and functions; such persons so appointed, as set out above, shall hold office during the pleasure of the council and shall give bond as the council requires and shall receive such compensation as the council prescribes.
(b) The council may shall establish and
maintain a police department which shall be under the supervision of a Chief of
Police, who shall serve continuously after appointment by the town council,
subject to dismissal by the town council, only because of: inefficiency;
malfeasance, misfeasance, and/or nonfeasance in office; other acts unbecoming a
Police Officer; poor health or retirement, which dismissal, if any, may be made
only after an appropriate investigation and hearing before the town council
according to rules and regulations set up by the town council be
appointed by the town council and serve at the pleasure of the town council.
