GOVERNOR'S RECOMMENDATION

        That the Commonwealth shall have a goal of reducing by 2023 the 2008-2023 growth rate by 40 percent of (i) the summer peak load (MW) and (ii) annual net energy (GWh) for the Virginia portion of each investor-owned public utility’s PJM zone or sub-zone, as reported in the PJM Interconnection’s January, 2008 PJM Peak Load Forecast Report projection of summer peak load and annual net energy, through implementation of cost-effective electric utility-sponsored or supported demand-side management and energy efficiency programs.  When considering an application filed by an investor-owned incumbent electric utility for a Certificate of Public Convenience and Necessity to construct a new generation facility or for approval and certification of electric transmission facilities, and when assessing the need for such facility or facilities, the Commission shall consider only the peak load reductions and net energy usage reductions reasonably expected to be achieved by utility-sponsored or supported demand-side management and energy efficiency programs, based on actual measured and verified reductions previously achieved, or on such other evidence that the Commission finds justifies such reasonable expectations.
