Driving without a license; penalties. Provides that a second offense of driving without a license is a Class 1 misdemeanor. Under current law all violations are Class 2 misdemeanors.
SUMMARY AS PASSED HOUSE:
Driving without a license; penalties. Provides that a second offense of driving without a license is a Class 1 misdemeanor. The bill also provides that any person convicted of a third or subsequent offense of driving without a license within a 10-year period shall serve a mandatory minimum term of confinement in jail of 10 days (that shall not be imposed in an emergency). A first offense of driving without a license is currently a Class 2 misdemeanor.
SUMMARY AS INTRODUCED:
Driving without a license; penalties. Provides that any person convicted of a third or subsequent offense of driving without a license within a 10-year period shall serve a mandatory minimum term of confinement in jail of 10 days. In addition, the bill also provides that when a person is convicted of driving on a suspended or revoked license under this section, the court shall suspend the person's privilege to drive for the same period for which it had been previously suspended. Also, when a person is convicted under this section of driving during a period of suspension or revocation that was not for a definite period of time or convicted of driving without a license, the court shall suspend the person's license or privilege to drive for an additional period not to exceed 90 days.
