SUMMARY AS PASSED HOUSE:
Criminal procedure; right to examine person performing analysis. Provides that if defendant requests the presence of the person as a witness who performed any laboratory analysis or examination or was involved in the chain of custody, his remedy, if the person is unavailable for trial, is a continuance.
SUMMARY AS INTRODUCED:
Criminal procedure; right to examine person performing analysis. Requires the accused to make a written request within 10 days of the filing of the certificate of analysis or at least three days prior to the hearing or trial, whichever is earlier, to the Clerk of Court, with notice to the attorney for the Commonwealth, for the presence of the person who performed any analysis or examination or was involved in the chain of custody.
