SUMMARY AS PASSED HOUSE:
Unintentionally causing death of fetus punishable as involuntary manslaughter. Provides that any person who, while engaged in gross, wanton and culpable conduct that shows a reckless disregard for the life or safety of others, causes injury to another person who is pregnant, and that conduct is the cause of a miscarriage or stillbirth, is guilty of a Class 5 felony.
SUMMARY AS INTRODUCED:
Unintentionally causing death of fetus punishable as involuntary manslaughter. Provides that any person who, while engaged in wanton and willful conduct that shows a reckless disregard for the safety of others, causes injury to another woman who is pregnant, and that conduct is the cause of a miscarriage or stillbirth by the woman, is guilty of involuntary manslaughter. Physicians acting in good faith in the performance of their duties are not liable under the section.
