SUMMARY AS PASSED HOUSE:

Donations of food to charitable organizations; deemed exempt from food service regulations. Exempts charitable organizations that engage in food distribution to the needy from state and local regulations and ordinances that govern food service and preparation. Includes non-profit homeless shelters and hunger prevention programs under the definition of "charitable organizations" for purposes of the exemption. Permits the Board of Health to issue advisory standards for food preparation, handling, protection, and preservation. The bill contains an emergency clause and will take effect upon passage. This bill incorporates HB 2258 (Rust) and is identical to SB 806 (Puller).

SUMMARY AS INTRODUCED:

Donations of food to charitable causes; exception to food service regulations.  Provides an exception for charitable organizations that engage in food distribution to the needy from both state and local regulations that require commercial-grade kitchens and equipment. Includes nonprofit homeless shelters and any volunteer who prepares food for such organizations under the definition of "charitable organizations" for purposes of this exception.  This bill will take effect at the time of its passage due to the nature of its subject.
