AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend the Code of Virginia by adding sections numbered 46.2-214.2 and 46.2-328.1, relating to service charges imposed and collected by the Department of Motor Vehicles; issuance of driver's licenses and learner's permits.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding sections numbered 46.2-214.2 and 46.2-328.1 as follows:

§ 46.2-214.2. Service charge to be imposed and collected by the Department.

A. In addition to any other fee imposed and collected by the Department, the Department shall impose and collect a service charge in an amount to be determined by the Commissioner for any transaction that is carried out in any of its customer service centers if the transaction is one that can be conducted by electronic means.  This service charge shall not apply, however, to:

1. Transactions involving driver's licenses, learner's permits, or identification cards;

2. Transactions conducted concurrently with transactions involving driver’s licenses, learner’s permits, or identification cards;

3. Transactions conducted concurrently with a transaction to which the service charge established by subsection A does not apply;

4. Transactions for which no other fee is charged by the Department; and

5. Manual transactions conducted by motor vehicle dealers subject to the provisions of § 46.2-1530.2.

B. No service charge imposed and collected pursuant to this section shall be less than $5 or exceed $20 for any single transaction.

C. All service charges imposed and collected by the Commissioner under this section shall be paid into the state treasury and shall be set aside as a special fund to be used to meet the expenses of the Department.

§ 46.2-328.2. Progress reports to General Assembly regarding transition to centralized manufacture and distribution of driver's licenses, learner’s permits, and identification cards.

The Commissioner shall submit reports to the General Assembly regarding the Department’s progress towards transitioning to centralized issuance of driver’s licenses, learner’s permits, and identification cards beginning September 30, 2007, and continuing, on a quarterly basis, until the transition has been completed.
