Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 46.2-1144.1 as follows:

§ 46.2-1144.1. Overweight permits for vehicles used to transport petroleum produces for residential or commercial heating.

The Commissioner, upon written application by the owner or operator of vehicles used exclusively to transport petroleum products for residential or commercial heating, shall issue without cost a permit authorizing the operation on the highway of such vehicles at weights provided in this section.

No permit issued under this section shall authorize a single axle weight of more than 24,000 pounds or a tandem axle weight, for tandem axles having more than 40 inches but not more than 96 inches spacing between axles centers, of more than 44,000 pounds, and gross weights of no more than 44,000 pounds for any single unit having two axles, 54,500 pounds for any single unit having three axles, 64,500 pounds for tractor truck-semitrailer combinations having 4 axles, and 90,000 for tractor truck-semitrailer combinations and tractor-truck twin-trailer combinations having 5 or more axles. No permit issued under this section shall authorize a weight of more than 850 pounds per inch of tire tread width in contact with the road surface. Such permit shall be obtained annually at the time the vehicle is registered. The Commissioner shall promulgate regulations governing such permits.
