068767304Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Article 10 of Chapter 10 of Title 46.2 a section numbered 46.2-1088.6 as follows:
§ 46.2-1088.6. Data recorders; ownership.
A. As used in this section, "recording device" means any device that is installed in a motor vehicle that records or transmits performance or operation information about that vehicle, including but not limited to speed, direction in which the vehicle is traveling, location data, steering performance, brake performance, seatbelt status, and information concerning a crash in which the motor vehicle has been involved. "Recording device" includes devices commonly referred to as "event data recorders" (EDR) or "sensing and diagnostic modules."
B. Data that is recorded on a recording device is deemed the personal property of the owner of the motor vehicle and may not be downloaded or otherwise retrieved by a person other than the owner, except (i) with the consent of the owner or (ii) in response to an order of a court of competent jurisdiction.
