066043396Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 54.1-2403.4 as follows:
§ 54.1-2403.4. Anonymous donations of gametes prohibited; health record to note identity.
A. No unrelated anonymous donor gametes shall be used by any healthcare professional licensed by a health regulatory board in the performance of or when assisting in the performance of any intervening medical technology that completely or partially replaces sexual intercourse as a means of conception.
B. Notwithstanding any traditional practice, agreement, regulation, or law to the contrary, the identity of any unrelated oocyte or sperm donor shall be noted in the health record of any woman patient whenever any healthcare practitioner licensed by a health regulatory board uses any unrelated donor gametes in the performance of or while assisting in the performance of any intervening medical technology, whether in vivo or in vitro, that completely or partially replaces sexual intercourse as a means of conception, including, but not limited to, artificial insemination by donor, cryopreservation of gametes and embryos, in vitro fertilization, embryo transfer, gamete intrafallopian tube transfer, and low tubal ovum transfer.
