Be it enacted by the General Assembly of Virginia:

1.  That the Code of Virginia is amended by adding a section numbered 18.2-109.1 as follows:

§ 18.2-109.1. Aggravated larceny; penalty.

Any person who commits assault or assault and battery while in the commission of, or in furtherance of, a larceny not from the person of another is guilty of aggravated larceny. A person who commits aggravated larceny of goods and chattels of the value of less than $200 is guilty of a Class 6 felony. A person who commits aggravated larceny of goods and chattels of the value of $200 or more is guilty of a Class 5 felony.

2. That the provisions of this act may result in a net increase in periods of imprisonment or commitment.  Pursuant to § 30-19.1:4, the estimated amount of the necessary appropriation is $1,353,742 for periods of imprisonment in state adult correctional facilities and cannot be determined for periods of commitment to the custody of the Department of Juvenile Justice.
