HOUSE BILL NO. 2622 AMENDMENT IN THE NATURE OF A SUBSTITUTE (Proposed by the House Committee for Courts of Justice on January 22, 2007) (Patron Prior to Substitute--Delegate Reid) A BILL to amend the Code of Virginia by adding in Article 3 of Chapter 12 of Title 18.2 a section numbered 18.2-511.1, relating to concealing illegal aliens; penalty.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 3 of Chapter 12 of Title 18.2 a section numbered 18.2-511.1 as follows:

§ 18.2-511.1. Concealing certain aliens; penalty.

Any person, knowing the alien is in the United States in violation of law, who, as a part of a commercial enterprise and with the purpose of violating the immigration laws of the United States (i) transports or moves or attempts to transport or move that alien into or within the Commonwealth; (ii) conceals or shields from detection or attempts to conceal or shield from detection that alien in any place, including any building or any vehicle, vessel or other thing used as a means for transporting people; or (iii) engages in any conspiracy to commit any of the acts in clauses (i) or (ii), is guilty of a Class 6 felony.

2. That the provisions of this act may result in a net increase in periods of imprisonment or commitment.  Pursuant to § 30-19.1:4, the estimated amount of the necessary appropriation cannot be determined for periods of imprisonment in state adult correctional facilities and is $0 for periods of commitment to the custody of the Department of Juvenile Justice.
