Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Article 3 of Chapter 12 of Title 18.2 a section numbered 18.2-511.1 as follows:
§ 18.2-511.1. Harboring certain aliens.
Any person, knowing or having reason to know that an alien came to, entered, or remains in the United States in violation of law, who (i) transports or moves or attempts to transport or move that alien into or within the Commonwealth; (ii) conceals, harbors, or shields from detection or attempts to conceal, harbor, or shield from detection that alien in any place, including any building or any means of transportation; or (iii) engages in any conspiracy to commit any of the acts in clauses (i) and (ii), is guilty of a Class 6 felony. However, any person who violates this section for the purpose of commercial advantage or private financial gain is guilty of a Class 5 felony.
2. That the provisions of this act may result in a net increase in periods of imprisonment or commitment. Pursuant to § 30-19.1:4, the estimated amount of the necessary appropriation cannot be determined for periods of imprisonment in state adult correctional facilities and cannot be determined for periods of commitment to the custody of the Department of Juvenile Justice.
