AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend the Code of Virginia by adding a section numbered 18.2-295.1, relating to certification of the transfer and registration of a weapon subject to the National Firearms Act.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 18.2-295.1 as follows:

§ 18.2-295.1. Certification of the transfer and registration of weapons subject to the National Firearms Act.

The Superintendent of the Department of State Police shall be deemed a chief law-enforcement officer in the Commonwealth for purposes of certification of the transfer and registration of weapons required to be certified pursuant to the National Firearms Act, 26 USC Chapter 53.

When the certification of the chief law-enforcement officer is required by federal law for certification of the transfer and registration of weapons, the Superintendent of State Police or his designee shall provide such certification within 15 days of receipt of the federal application and the request for certification, so long as the Superintendent does not have any information that the applicant is prohibited by law from receiving the firearm.
