Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 8.01-4.4 as follows:

8.01-4.4. Requirement of lawful immigration status for state determination of legal domicile.

For all State determinations where legal residence or legal domicile is required by Virginia law, an alien not lawfully present within the United States shall not be deemed domiciled or a resident, or possess the intent to establish domicile or residence in the Commonwealth.
