Be it enacted by the General Assembly of Virginia:
1. That § 40.1-28.10 of the Code of Virginia is amended and reenacted as follows:
§ 40.1-28.10. Minimum wages.
EveryA. Prior to July 1,
2007, every employer shall pay to each of his employees wages at a
rate not less than the federal minimum wage and a or,
if applicable, the federal training wage as prescribed by the U.S.
Fair Labor Standards Act (29 U.S.C. § 201 et seq.).
B. From July 1, 2007, until July 1, 2008, every employer shall pay to each of his employees wages at a rate not less than $6.15 per hour.
C. From July 1, 2008, until July 1, 2009, every employer shall pay to each of his employees wages at a rate not less than $7.15 per hour.
D. From July 1, 2009, until July 1, 2010, every employer shall pay to each of his employees wages at a rate not less than $8.15 per hour.
E. For the 12-month period commencing July 1, 2010, and each subsequent 12-month period, every employer shall pay to each of his employees wages at a rate not less than the minimum wage rate in effect during the preceding 12-month period as adjusted by the rate of change in the Consumer Price Index as reported by the Bureau of Labor Statistics of the United States Department of Labor for the immediately preceding calendar year, which rate shall be determined annually by the Commissioner.
