Be it enacted by the General Assembly of Virginia:

1.  That § 14 of Chapter 560 of the Acts of Assembly of 1995 is amended and reenacted and that Chapter 560 of the Acts of Assembly of 1995 is amended by adding sections numbered 10a, 15, 16, and 17 as follows:

§ 10a. The Commonwealth Transportation Board shall hold any hearings on proposed toll increases for the Dulles Toll Road within the counties of Fairfax and Loudoun and provide residents 30 days' notice of such hearings.

§ 14. Notwithstanding any other provisions of this act and to the extent permitted by law, the Commonwealth Transportation Board may provide for the additional improvements to the Dulles Toll Road and Dulles Access Road corridor (extending from Interstate 495 in Fairfax County to Route 28 (Sully Road) in Loudoun County) including, but not limited to, mass transit, including rail, and capacity-enhancing treatments, such as High Occupancy Vehicle lanes, interchange improvements, commuter parking lots and other transportation management strategies, from surplus net revenues of the Dulles Toll Road prior to provision being made for the retirement of all bonds issued under the provisions of this act. At least 50% of surplus net revenues of the Dulles Toll Road shall be dedicated to road and interchange improvements on the Dulles Toll Road and access roads.

§ 15. All tolls for the Dulles Toll Road that are collected by the Dulles Greenway and that are intended for mass transit improvements in the Dulles Corridor (including Metrorail) shall be held in escrow for the extension of Metrorail beyond Tyson's Corner.

§ 16. Should Metrorail not be extended beyond Tyson's Corner by January 1, 2015, the escrowed tolls shall be available for express bus service serving Loudoun County.

§ 17. Tolls shall not be raised in excess of $2 at the Tysons Corner/Route 7 main plaza of the Dulles Toll Road or in excess of $1 at each exit in order to finance the extension of mass transit in the Dulles Corridor, including Metrorail, unless the governing body of Loudoun County and the governing body of Fairfax County each put the issue of such increases to referendum of the voters in each county on the November ballot in the same even-numbered election year, and such toll increases are approved by a majority of the voters at such referendum. For purposes of this section, "a majority of the voters" means a majority of the total number of voters voting on the issue in both counties regardless of the outcome of the vote in each county.
