insert
6. That any person or entity subject to the fee imposed under § 33.1-23.05 of the Code of Virginia who includes such fee in the rates or charges it collects for blended fuel, diesel fuel, or gasoline, as such terms are defined in § 33.1-23.05, shall be subject to an annual penalty as determined by the tax commissioner.
