SB 406 Electric authorities; distributing electric energy for retail sales to customers within area.

SUMMARY AS ENACTED WITH GOVERNOR'S RECOMMENDATION:

Electric authorities.  Amends the Electric Authorities Act. An electric authority created by the Town of Elkton in which the Town is the authority's sole member is (i) subject to taxation only to the extent that the Town is subject to such taxation; (ii) subject to the provisions of the Virginia Personnel Act and the Virginia Public Procurement Act in the exercise of any power conferred under the Electric Authorities Act only to the extent that such provisions would have applied to the Town of Elkton in the exercise of such power directly; and (iii) authorized to distribute electric energy for retail sale within the geographic area that was served as of January 1, 2006, by the Town of Elkton.  In addition, the bill provides that the provisions of the Virginia Electric Utility Restructuring Act shall not impair the exclusive territorial rights of an authority created by the Town of Elkton in which the Town is the authority's sole member.  This bill is identical to HB 1187.

SUMMARY AS INTRODUCED:

Electric authorities.  Amends the Electric Authorities Act. The bill confers the authority for single member authorities to distribute electric energy for retail sales to customers within their geographic or certificated area. In addition, a governmental unit no longer has to conduct a referendum in order to create a single member authority of which it is the sole member. Furthermore, a single member authority undertaking a project is held to the same state and federal provisions, and to the same extent, that would have applied to the governmental unit that is the sole member of such authority if such governmental unit had directly undertaken the project. The Virginia Personnel Act and the Virginia Public Procurement Act apply to a single member authority to the extent that such provisions would have applied to the authority's single member governmental unit in the exercise of such power directly. The bill further exempts single member authorities from the Virginia Electric Utility Restructuring Act and from paying taxes to the governmental unit that is its sole member.  This bill is identical to HB 406.
