SUMMARY AS PASSED:

Criminal street gang members; conditions of probation. Provides that the court, when sentencing an active participant or member of a criminal street gang, may, as a condition of probation or a suspended sentence, place reasonable restrictions on with whom the accused may have contact. The bill creates an exception for those who are members of the person's family or household. This bill is identical to HB 901.

SUMMARY AS PASSED SENATE:

No contact with criminal street gang members; penalty. Allows the court to order, as a condition of release on bond, that a person not have any contact with a specifically identified member of a criminal street gang.  When a person is convicted of a gang-related crime the court may reasonably restrict, as a condition of probation or suspended sentence, the person's contacts with other people, including anyone he knows to be a member of a criminal street gang, except for family or household members.

SUMMARY AS INTRODUCED:

No contact with criminal street gang members; penalty. Allows the court to order, as a condition of probation or a suspended sentence or release on bond, that a person not have any contact with a member of a criminal street gang, and mandates the condition upon conviction of a gang-related crime.
