SB 146 Methamphetamine precursor drugs; sale of ephedrine and pseudoephedrine with restrictions, penalty.

SUMMARY AS ENACTED WITH GOVERNOR'S RECOMMENDATION:

Sale of methamphetamine precursor drugs ephedrine and pseudoephedrine; penalty. Provides that no more than 3.6 grams of either ephedrine or pseudoephedrine may be sold daily to an individual in a retail sale and that retail personnel shall be instructed in special procedures to be used in the sale of products containing such drugs. Effective September 30, 2006, when a substance containing such drugs is provided or sold it shall be displayed behind a sales counter or in a locked case and the purchaser must present a photo ID.  If more than one package is purchased, the purchaser must sign a log maintained by the seller.  The penalty for violation of these provisions is a Class 1 misdemeanor.  This bill incorporates SB 314 and SB 554.  This bill is identical to HB 1040.

Sale of pseudoephedrine by pharmacist; limits on purchase of pseudoephedrine; penalty.  Provides that no person shall offer methamphetamine precursor drugs (ephedrine and pseudoephedrine) for retail sale except from behind the counter or with other comparable restrictions.  The bill also provides that no more than nine grams of pseudoephedrine may be sold to one person.  The penalty for violation of these provisions is a Class 1 misdemeanor.  This bill incorporates SB 314 and SB 554.  This bill is identical to HB 1040.

SUMMARY AS INTRODUCED:

Sale of methamphetamine precursor drugs ephedrine and pseudoephedrine; penalty. Provides that no person shall offer methamphetamine precursor drugs (ephedrine and pseudoephedrine) for retail sale except from behind the counter or with other comparable restrictions. No more than three packages may be sold. No more than nine grams may be sold. The seller is also required to record the purchaser's name and the date of purchase. The purchaser must sign the purchase log. The log may not be revealed except to law enforcement. A violation of this provision is a Class 1 misdemeanor.
