SUMMARY AS PASSED HOUSE:
Impaired waters. Allows an aggrieved party to conduct a use attainability analysis in order to demonstrate that the attainment of the designated use for an impaired water body is not feasible. This analysis would be submitted to, and reviewed by, the State Water Control Board. The Board would then determine whether the development or implementation of the total maximum daily load should be delayed.
SUMMARY AS INTRODUCED:
Impaired waters. Requires the State Water Control Board to evaluate the attainability of meeting water quality standards for an impaired water, if the costs of improving the water quality are greater than the benefits to be derived. This assessment is to be conducted before developing or implementing the total maximum daily load.
