SUMMARY AS PASSED:
Process for issuance of search and arrest warrants. Provides that where an appearance is required or permitted, and that appearance is made by two-way electronic video and audio communication, documents may be transmitted by facsimile between the magistrate, intake officer, or judge, and the person appearing before such magistrate, intake officer, or judge. Additionally, when seeking a search warrant, the person seeking the search warrant may file the required affidavit by electronically transmitted facsimile process.

Process for issuance of search and arrest warrants. Provides that a person who seeks a search warrant may communicate with the issuing officer by facsimile and use a facsimile to transmit the affidavit for processing and issuing a search warrant.

Process for issuance of search and arrest warrants. Provides that a person who seeks a search warrant may confer with the issuing officer by telephone or radio prior to appearing before the issuing officer for a preliminary determination from the officer as to the sufficiency of probable cause for the warrant, and allows the use of facsimile to transmit the affidavit for processing and issuing a search warrant.
