SUMMARY AS PASSED HOUSE: (all summaries)

Public institutions of higher education; intellectual property. Requires each public institution of higher education to adopt a policy concerning assignment of intellectual property to govern any research contracts to which it is a party. Each institution must forward a copy of its policies to the Governor and the Joint Commission on Technology and Science and report annually to the Governor and the Joint Commission on Technology and Science as to the assignment of any intellectual property interests by that institution. Under the bill, the prior approval of the Governor is still required for transfers of intellectual property developed wholly or predominately through the use of state funds. The bill also requires the Department of Budget and Planning to issue by December 1, 2006, guidelines defining (i) the conditions under which projects are to be considered wholly or predominately funded by the general fund and (ii) procedures for an expedited review by the Governor of relevant transfers of intellectual properties.
