SUMMARY AS INTRODUCED:
Arrest for traffic misdemeanor. Clarifies language in the motor vehicle code by requiring a magistrate to proceed with a probable cause determination under § 19.2-82 when an arrestee is brought before him following a traffic misdemeanor. Currently, an officer may release a suspected traffic misdemeanant on a summons unless the person refuses to appear, is likely not to appear, or is suspected of committing a felony. Current vehicle code language is not expansive enough to cover those scenarios when the suspect is arrested and taken before a magistrate.
