SUMMARY AS PASSED:

Virginia Post-Disaster Anti-Price Gouging Act.  Authorizes the Governor, upon finding that during a disaster a supplier is selling necessary goods or services at such an unconscionable price that it presents an imminent and substantial danger to the public welfare by creating public panic, to issue 30-day emergency orders requiring the supplier to reduce the price to the prevailing price in the local market. 

SUMMARY AS PASSED HOUSE:

Virginia Post-Disaster Anti-Price Gouging Act; civil penalties.  Authorizes the Governor, upon finding that a supplier is selling necessary goods or services at such an unconscionable price that it presents an imminent and substantial danger to the public welfare by creating public panic or economic disruption, to issue emergency orders requiring the supplier to reduce the price to the prevailing price in the local market.  Such orders shall not be issued until the supplier is given the opportunity to demonstrate that such price in not unconscionable.  Violation of an injunction or other court order directing compliance with the emergency order is punishable by a civil penalty not to exceed $2,500.

Virginia Post-Disaster Anti-Price Gouging Act; civil penalties.  Authorizes the Commissioner of Agriculture and Consumer Services to issue special orders requiring violators of the Virginia Post-Disaster Anti-Price Gouging Act to pay civil penalties of up to $2,500 per violation per day.
