SUMMARY AS PASSED:

Indigent defendants; appointment of counsel.  Provides that if no attorney who is on the list maintained by the Indigent Defense Commission is reasonably available, the court may appoint as counsel an attorney not on the list who has otherwise demonstrated to the court's satisfaction an appropriate level of training and experience.  The court is required to provide notice of the appointment to the Commission.  These provisions will expire on July 1, 2008.

SUMMARY AS PASSED HOUSE:

Criminal procedure; determination of indigency; appointment of counsel. Allows the court to appoint counsel who is not on the list from the Indigent Defense Commission when in the opinion of the court the attorney has the requisite training and experience, and that such appointment shall not form the basis for a claim of error at trial, on appeal or in a habeas corpus proceeding.
