SENATE JOINT RESOLUTION NO. 120
Directing the Virginia State Crime Commission to study the monitoring of sex offenders in nursing homes and assisted living facilities. Report.

WHEREAS, there are 13,265 sex offenders on Virginia's Sex Offender and Crimes Against Minors Registry as of May 2005; and

WHEREAS, approximately 1,100 sex offenders will be added to the Sex Offender and Crimes Against Minors Registry every year; and

WHEREAS, recent studies indicate that sex offenders recidivate at a rate of 26%, when recidivism is measured as any new arrest for a sex offense or other crime against the person; and

WHEREAS, nursing homes have not previously been an entity eligible to receive automatic notification of registered sex offenders; now, therefore, be it

RESOLVED by the Senate, the House of Delegates concurring, That the Virginia State Crime Commission be directed to study the monitoring of sex offenders in nursing homes and assisted living facilities. 

In conducting its study, the Virginia State Crime Commission shall examine:

1. Avenues to better protect residents from sex offenders;

2. Current procedures to protect residents from other residents who may commit sex offenses due to debilitating physical and mental self-control as a result of stroke and other illnesses;

3. The number of prisoners being released on geriatric parole;

4. The number of registered sex offenders housed in nursing homes and assisted living facilities in Virginia;

5. Notification and monitoring of sex offenders in Virginia's nursing homes and assisted living facilities; and

6. Treatment options available to sex offenders housed in nursing homes and assisted living facilities in Virginia. 

All agencies of the Commonwealth shall provide assistance to the Virginia State Crime Commission for this study, upon request.

The Virginia State Crime Commission shall complete its meetings by November 1, 2006, and the Chairman shall submit to the Division of Legislative Automated Systems an executive summary of its findings and recommendations no later than the first day of the 2007 Regular Session of the General Assembly. The executive summary shall state whether the Virginia State Crime Commission intends to submit to the General Assembly and the Governor a report of its findings and recommendations for publication as a House or Senate document. The executive summary and report shall be submitted as provided in the procedures of the Division of Legislative Automated Systems for the processing of legislative documents and reports and shall be posted on the General Assembly's website.
