063732844Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 2.2-1176.1 as follows:
§ 2.2-1176.1. Purchase or lease of energy efficient vehicles.
Any passenger-type vehicles purchased or leased with public
funds by any department, agency, institution, or commission of the
Commonwealth, or any officer or employee on behalf of the Commonwealth shall be
of the highest fuel economy and lowest pollutant emissions available for the
vehicle's intended purpose. The Division of Energy, within the Department of
Mines, Minerals and Energy, in conjunction with the [ Department
of Transportation Department of General Services
] and the Department of Environmental Quality, shall establish a list of
conforming vehicles for specific classes of use. Consideration shall be given
to [ cost-effectiveness, lifetime fuel savings, and
reduction in air quality externalities versus increased purchase cost of
cleaner, more fuel-efficient vehicles, taking into account increased value at
resale. total life-cycle cost of
vehicles when determining the list of conforming vehicles.
For the purposes of this section, “life-cycle cost of vehicles” means the total cost of ownership for a vehicle computed by considering capital, operating, salvage, and environmental costs. ]
The following vehicles shall not be subject to the provisions of this section:
1. Vehicles that have special equipment or performance requirements related to use by law-enforcement officers;
2. Vehicles for use by any elected official of the people of the Commonwealth;
3. Vehicles purchased by the Department of Transportation and used directly in carrying out its maintenance, operations, and construction programs; and
4. Such other special category of vehicles as may be excepted by the Director.
