066511726Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 20-14.3 as follows:
§ 20-14.3. Proof of U.S. citizenship or legal presence required prior to issuance of marriage license; penalty.
The clerk issuing any marriage license shall before issuing the license require each of the parties contemplating marriage to provide, under oath, valid documentary evidence that each of the applicants is either (i) a citizen of the United States, (ii) a legal permanent resident of the United States, or (iii) a conditional resident alien of the United States.
The issuance of an original license, permit, or special identification card as provided under § 46.2-328.1 by the Virginia Department of Motor Vehicles shall satisfy the requirements of this section. For the purposes of this section, any applicant for a marriage license who, under oath, makes a false statement or presents a false document shall be guilty of perjury.
