SENATE BILL NO. 349 AMENDMENT IN THE NATURE OF A SUBSTITUTE (Proposed by the Senate Committee on Agriculture, Conservation and Natural Resources on January 30, 2006) (Patrons Prior to Substitute--Senators Howell and Cuccinelli [354]) A BILL to amend the Code of Virginia by adding a section numbered 3.1-396.1, and to repeal § 18.2-236 of the Code of Virginia, relating to halal and kosher foods; penalty.

Be it enacted by the General Assembly of Virginia:

1.  That the Code of Virginia is amended by adding a section numbered 3.1-396.1 as follows:

§ 3.1-396.1. Labeling as kosher and halal; penalty.

It shall be unlawful to label any food or food product or display any unwrapped food or food product for sale that represents the food or food product as kosher or halal without indicating the authority for such designation or providing a toll-free number or website to access the information.

Any person who shall knowingly violate any provision of this section shall be guilty of a Class 3 misdemeanor.

2.  That § 18.2-236 of the Code of Virginia is repealed.
