WHEREAS, many public rest areas are located near 24-hour private facilities; and

WHEREAS, business is taken away from these private facilities because travelers choose to use the public rest areas provided by the Commonwealth; and

WHEREAS, a public rest area is not needed if there is a 24-hour private facility in close proximity; and

WHEREAS, unnecessary money is expended on certain public rest areas because of their close proximity to a 24-hour facility; now, therefore, be it

RESOLVED by the House of Delegates, the Senate concurring, That the Department of Transportation be requested to collect data on public rest areas and their proximity to 24-hour facilities.

In collecting the data, the Department of Transportation shall report the exact distance from all public rest areas in the Commonwealth to the nearest 24-hour private facility.

Technical assistance shall be provided to the Department of Transportation by the Division of Legislative Automated Systems. All agencies of the Commonwealth shall provide assistance to the Department of Transportation in collecting the information, upon request.

The Department of Transportation shall submit to the Division of Legislative Automated Systems an executive summary and the data collected on public rest areas and their proximity to 24-hour facilities no later than the first day of the 2007 Regular Session of the General Assembly. The executive summary shall be submitted for publication as a report document as provided in the procedures of the Division of Legislative Automated Systems for the processing of legislative documents and reports and shall be posted on the General Assembly's website.
