Be it enacted by the General Assembly of Virginia:

1.  § 1. If, in the general appropriation act for fiscal year 2006-2007, allocations are not made to fund any future construction, reconstruction, or improvement projects involving the "Smart Road" in the Salem Highway Construction District, the Commonwealth Transportation Commissioner shall reimburse the Salem Highway Construction District for all funds expended to date in constructing, reconstructing, or improving the "Smart Road."
