Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 1 of Chapter 8 of Title 22.1 a section numbered 22.1-101.2, as follows:

§ 22.1-101.2. English as a Second Language Grant Program.

A. With such funds as may be appropriated for such purpose and from such gifts, donations, grants, bequests, and other funds as may be received on its behalf, there is hereby established the English as a Second Language Grant Program (the Program), to be administered by the Board of Education. The Program shall provide grants to school divisions in which at least 25% of the student population receives English as a second language instruction.

B. The Board shall promulgate regulations governing the disbursement of such grants and provide rules and guidelines for the use of funds received by school divisions from the Program. Each school division receiving such funds shall submit a report to the Board specifying how the funds were used or are intended to be used in the school division.
