Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 62.1-44.15:02 as follows:

§ 62.1-44.15:02. Upgrading of publicly owned treatment works.

By July 1, 2010, every publicly owned treatment works, as defined in § 10.1-2117, serving a population of 55,000 or greater shall meet the load allocations limits for the discharge of nitrogen and phosphorus established by the Board in order to restore the quality of Virginia's waters, by either installing the necessary nutrient treatment removal technology or by participating in the nutrient credit exchange program established pursuant to Article 4.02 (§ 62.1-44.19:12 et seq.) of Chapter 3.1 of this title.
