AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend the Code of Virginia by adding a section numbered 15.2-2288.2, relating to special use permits for certain temporary structures.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 15.2-2288.2 as follows:

§ 15.2-2288.2.  Localities may not require special use permit for certain temporary structures.

A zoning ordinance shall not require that a special exception or special use permit be obtained in order to erect a tent (i) intended to serve as a temporary structure for a period of three days or less and (ii) that will be used primarily for private or family-related events including, but not limited to, weddings and estate sales.
