Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 1 of Chapter 2 of Title 33.1 a section numbered 33.1-228.1 as follows:

§ 33.1-228.1. Agreements between localities for construction and operation of toll facilities.

The governing bodies of any adjacent counties, cities, and towns may enter into agreements providing for the construction and operation of highways, bridges, and ferries within their boundaries and for the imposition and collection of tolls for the use of such facilities. Such tolls may be in whatever amount, subject to whatever conditions, and expended for whatever purposes provided for in such agreements. Any facility constructed under this section shall be subject to approval by the Virginia Department of Transportation only insofar as such facility intersects with or crosses a facility controlled by the Department. Any and all funds available to affected counties, cities, and towns for public purposes may be used in the planning, construction, and operation of any such facilities without limitation.
