AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend the Code of Virginia by adding a section numbered 18.2-46.7:01, relating to tampering with waterworks; penalty.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 18.2-46.7:01 as follows:

§ 18.2-46.7:01. Tampering with waterworks.

A. Any person who maliciously tampers with a waterworks, as defined by § 32.1-167, is guilty of a Class 3 felony. Any person who unlawfully but not maliciously tampers with a waterworks is guilty of a Class 6 felony.

B. For the purposes of this section "tamper" means to introduce any hazardous physical, chemical, biological, or radiological substance or matter into a waterworks with the intention of harming people.

2. That the provisions of this act may result in a net increase in periods of imprisonment or commitment.  Pursuant to § 30-19.1:4, the estimated amount of the necessary appropriation cannot be determined for periods of imprisonment in state adult correctional facilities and cannot be determined for periods of commitment to the custody of the Department of Juvenile Justice.
