066208298Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 18.2-46.7:01 as follows:
§ 18.2-46.7:01. Tampering with waterworks.
A. Any person who tampers with a waterworks, as defined by § 32.1-167, shall be guilty of a Class 3 felony. If the tampering results in the death of another, the person shall be guilty of a Class 2 felony.
B. Any person who attempts to tamper, or makes a threat to tamper, with a waterworks shall be guilty of a Class 4 felony.
C. For the purposes of this section "tamper" means to (i) introduce any objectionable or hazardous physical, chemical, biological, or radiological substance or matter into a waterworks with the intention of harming people or (ii) interfere with the operation of a waterworks with the intention of harming people.
2. That the provisions of this act may result in a net increase in periods of imprisonment or commitment. Pursuant to § 30-19.1:4, the estimated amount of the necessary appropriation cannot be determined for periods of imprisonment in state adult correctional facilities and cannot be determined for periods of commitment to the custody of the Department of Juvenile Justice.
