Be it enacted by the General Assembly of Virginia:

1.  That the Code of Virginia is amended by adding a section numbered 2.2-4311.1 as follows:

§ 2.2-4311.1. Prohibited contracts; required contract provisions.

A. No public body shall enter into any contract for goods, services, or construction with any potential bidder or offeror that employs in any aspect of such person's business, individuals other than citizens of the United States, legal resident aliens, or individuals with a valid visa.

B. All public bodies shall include in every contract for goods, services, or construction the following provisions:

1. During the performance of this contract, the contractor agrees as follows:

a. The contractor will post in conspicuous places, available to employees and applicants for employment, a statement notifying such persons that only citizens of the United States, legal resident aliens, and individuals with a valid visa will be hired to provide the goods or perform the services under the contract or any subcontract of such contract; and

b. The contractor will state in all solicitations or advertisements for employees placed by or on behalf of the contractor that the contractor will hire only citizens of the United States, legal resident aliens, and individuals with a valid visa to perform the services under the contract or any subcontract of such contract.

2. The contractor will include the provisions of the foregoing clauses in every subcontract or purchase order, so that the provisions will be binding upon each subcontractor or vendor.
