A BILL to amend the Code of Virginia by adding in Article 2 of Chapter 2 of Title 2.2 a section numbered 2.2-203.2:2, relating to the Secretary of Administration; office space utilization.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 2 of Chapter 2 of Title 2.2 a section numbered 2.2-203.2:2 as follows:

§ 2.2 -203.2:2. Office space utilization.

A. The Secretary shall require each agency head to determine the actual daily utilization of each and every workspace within all state government-owned or leased buildings or facilities. Actual utilization shall be determined by comparing the number of days a workspace is actually used to the time the workspace is available for use.

B. The head of each agency shall set annual percentage targets for the increase of workspace utilization. Improvements in utilization shall be measured against a baseline utilization as of July 1, 2007.

C. Each agency shall implement the technologies necessary to verify the use of each workspace each day, including but not limited to telephone activation and use and integration of the building’s electronic security system with its workplace scheduling and management system. 

D. The head of each state agency shall annually report to the Secretary of Administration or his designee on the utilization of workspaces under his management. Any agency head failing to comply with the requirements of this section shall forfeit 1% of the moneys appropriated for the operation of the agency as provided in the appropriation act. The Secretary shall so notify the Comptroller, who shall take such moneys and deposit them into the Literary Fund.

E. As used in this section:

“Workspace” means a work location that provides at a minimum a chair, a work surface, and a telephone, used by a single employee to perform normal work activities. 

“Workspace actual utilization” means the duration a workspace is actually used divided by the duration a workspace is available for use.

"Workspace is actually used" means the total number of days that a workspace is actually used by a worker during any given time period (week, month, year).

"Workspace is available for use" means the total number of normal business days that a workspace is available for operational use during any given time period (week, month, year).
