060833301Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 3.1-796.76:1 as follows:
§ 3.1-796.76:1. State Veterinarian inspection of releasing agencies and pet stores; civil penalty.
The State Veterinarian or his designee shall conduct routine inspections of every pound and shelter once annually. Pet shops shall be inspected twice annually. The purpose of the inspection is to determine if a violation of (i) this chapter; (ii) any other state law governing the care, control, or protection of animals; or (iii) any other state law governing property rights in animals has occurred. Inspections shall be conducted during normal business hours.
Violations that remain uncorrected 30 days from the initial inspection shall be subject to a civil penalty of $500 per violation per day. Such civil penalties shall be paid into a special fund in the state treasury to the credit of the Department to be used in carrying out the purposes of this chapter.
